1.1 These terms govern access to and use of the Innov8 Spaces website, including its content, enquiry forms and links to booking or payment services ("Website").
1.2 By using the Website, you agree to comply with these terms. A booking or other transaction is governed by the separate terms presented before the transaction is concluded.
1.3 If you do not agree with these terms, you should stop using the Website. Merely browsing the Website does not constitute consent to direct marketing or to processing that requires separate consent.
2.1 You may use the Website for lawful personal or business enquiries, to obtain information, and to make or manage bookings through the available channels.
2.2 You may not attempt to gain unauthorised access, introduce malicious code, interfere with the Website or another user, scrape or harvest information contrary to law, impersonate another person, submit false information, or use the Website for fraudulent or unlawful activity.
2.3 Automated indexing by legitimate public search engines is permitted. Other systematic extraction, crawling or reproduction for commercial use requires prior written permission.
3.1 Innov8 takes reasonable steps to keep Website information accurate and current, but availability, rates and accommodation details may change. A booking is binding only when confirmed in writing.
3.2 Images, virtual tours and descriptions are illustrative. They may depict a representative apartment rather than the specific unit allocated, but Innov8 will not knowingly make a materially misleading representation.
3.3 The Website may be unavailable or interrupted for maintenance, security, provider failures or circumstances beyond Innov8's reasonable control. Innov8 does not warrant uninterrupted or error-free access.
4.1 Before concluding an online booking, the Website or booking interface will display or make available the material service description, price, payment method, booking terms, cancellation and refund rules, privacy information and steps required to complete or correct the transaction.
4.2 You are responsible for checking dates, accommodation type, occupancy, contact details, rate conditions and the total price before submitting a booking.
4.3 Where technically available, you may correct input errors before final submission. Please contact reservations@innov8spaces.co.za promptly if a confirmation contains an error.
4.4 Electronic records and communications may be retained in a form accessible for later reference. You should also download or retain the confirmation and accepted terms.
5.1 Payment methods currently accepted, depending on the transaction channel, are cash, Visa and Mastercard. Card payments are subject to the rules of the relevant bank, card scheme and authorised payment service provider. Innov8 may add or remove methods for future transactions.
5.2 Payment-card data may be collected directly by an authorised payment provider. Innov8 will not represent that it has no access to any payment-related information unless this is technically and operationally accurate.
5.3 Do not make payment to changed banking details without independent verification through the telephone number published on the Website.
6.1 The Website, branding, text, graphics, photographs, videos, software, databases and other content are owned by or licensed to Innov8 and are protected by applicable intellectual-property laws.
6.2 You may view, download or print a reasonable copy for personal, non-commercial use. You may not reproduce, adapt, republish, sell, license or commercially exploit the content without prior written permission, except as permitted by law.
6.3 Third-party names, logos and content remain the property of their respective owners.
7.1 Where you submit an enquiry, review, image or other content, you confirm that it is lawful, accurate to the best of your knowledge, and does not infringe another person's rights.
7.2 You grant Innov8 a non-exclusive permission to use a submission only to respond, provide the requested service, administer the relationship, or publish it where you have knowingly submitted it for publication. Personal information is processed under the Privacy Notice.
7.3 Innov8 may remove unlawful, misleading, offensive or irrelevant public submissions, subject to applicable law.
8.1 The Website may link to booking platforms, maps, social networks, payment providers or other third-party services. Those services are independently operated and have their own terms and privacy notices.
8.2 Innov8 is not responsible for a third party's content, availability or conduct, but this does not limit Innov8's responsibility for a provider acting as its operator or agent where the law makes Innov8 accountable.
9.1 The Privacy Notice explains how Innov8 processes personal information. The Cookie Policy explains cookies and similar technologies and how preferences may be managed.
9.2 Necessary technologies may be used to operate and secure the Website. Non-essential analytics or marketing technologies will be managed through the available consent mechanism.
10.1 Innov8 uses reasonable measures to protect the Website, but no internet system is completely secure. You are responsible for securing your device, credentials and communications and for notifying Innov8 of suspected fraud or unauthorised use.
10.2 Innov8 may suspend access, block traffic or investigate activity where reasonably necessary to protect users, systems, property or legal rights.
IMPORTANT LIABILITY NOTICE: This clause limits certain claims connected with use of the Website. It does not exclude gross negligence, wilful misconduct or any liability or statutory right that cannot lawfully be excluded.
11.1 To the maximum extent permitted by law, Innov8 is not liable for indirect or consequential loss arising solely from Website downtime, third-party links, malicious code introduced by third parties, or reliance on general Website information that is not part of a confirmed transaction.
11.2 Where Innov8 is legally liable, its liability will be determined under applicable law and, where permitted, limited to reasonably foreseeable direct loss proved to have resulted from the breach.
11.3 Nothing in these terms limits rights under the CPA, ECTA, POPIA or other mandatory law.
12.1 Innov8 may update these Website terms by publishing a revised version and effective date. Changes apply prospectively. Terms accepted for a confirmed booking will not be altered by a later Website update unless agreed or required by law.

13.2 Electronic communications are deemed received when capable of being retrieved at the recipient's designated address, subject to applicable law and proof to the contrary.
14.1 South African law governs these terms. A consumer may approach any court, regulator, ombud or other forum that has jurisdiction.
14.2 If a provision is invalid or unenforceable, it will be limited or severed to the minimum extent necessary and the remaining provisions will continue to apply.
14.3 No failure to enforce a provision is a waiver of the right to enforce it later.
